Terms of Service
Our Privacy Policy explains what we do with your data and forms part of these terms.
1. Accepting these terms
By creating an account or using Gestic you accept these terms. If you do not accept them, do not use the service.
You must be at least 16 years old, or the minimum age at which you can consent to an online service where you live, whichever is higher. If you use Gestic on behalf of a business, you confirm you are authorised to accept these terms for it.
2. What Gestic is
Gestic helps you catalogue, value and manage a trading card collection. It scans cards, matches them against public card data, shows market prices gathered from third parties, and offers tools to organise, share and list what you own.
Gestic is a record-keeping and information tool. It is not a marketplace, not a broker, not an appraiser, and not a party to any sale you make.
3. Your account
- Keep your password and any API keys confidential. Activity under your account is your responsibility.
- Give accurate registration details and keep your email address current — it is how we reach you about your account.
- One account per person. Do not share an account, and do not create accounts automatically or in bulk.
- Tell us promptly at support@gestic.org if you believe your account has been accessed by someone else.
4. Card prices and valuations
Prices shown in Gestic are informational estimates. They are not an appraisal, not a valuation, not an offer, and not financial or investment advice.
- Prices come from third-party sources, including Scryfall and a number of card retailers. We pass them through. We do not set them and cannot guarantee that any of them is current, accurate, or achievable.
- Figures such as a list total, a price-history chart, or an automatically proposed sale price are calculations over that third-party data and carry the same limits.
- Currency conversion is applied at a rate that may differ from the rate you actually get.
- Do not rely on a Gestic figure to buy, sell, insure, or divide a collection. Check the market yourself before you act on money. Decisions you make using Gestic's numbers are yours alone.
5. Card recognition and scanning
The scanner identifies cards automatically, and it will sometimes be wrong. It can pick the wrong printing, the wrong set, the wrong language, or fail to recognise a card at all. That is a normal limitation of image recognition, not a fault of the service.
Scan results are a suggestion to be checked, not a verified record. You are responsible for reviewing what is added to your collection, particularly before using it for a sale, an insurance claim, or anything else that matters. Gestic gives you review and editing tools for exactly that purpose.
Nothing in Gestic authenticates a card. We cannot tell you whether a card is genuine, what condition it is in, or whether it has been altered.
6. Your content, and what is public
Your lists, notes, images and other content remain yours. We claim no ownership of them.
You grant Gestic a worldwide, non-exclusive, royalty-free licence to host, store, copy, adapt and display your content solely so that we can operate the service for you — for example rendering your lists, generating a shared page you asked for, or keeping a backup. This licence ends when you delete the content or your account, except for copies in routine backups that are overwritten in the ordinary course.
Some things are public by design. Depending on the features you use, a list, a
deck page, or a public profile at /u/your-nickname may be visible to anyone with the
link and may be indexed by search engines. Check the visibility of anything you would rather keep
private. We do not treat published content as confidential.
You are responsible for what you upload. Do not post anything unlawful, infringing, abusive, or that you do not have the right to share. We may remove content that breaks these terms.
7. Subscriptions, billing and refunds
- Gestic offers a free tier and paid plans. What each plan includes, and what it costs, is shown on the subscription page at the time you subscribe. Those pages are the current terms of the offer.
- Payments are handled by Stripe. We do not receive or store your full card details. Stripe's own terms apply to the payment itself.
- Paid plans renew automatically for the same period until you cancel. You can cancel at any time; cancellation takes effect at the end of the period you have already paid for, and there is no partial refund for the remainder of that period.
- We may change prices. A change never applies to a period you have already paid for, and we will tell you before it applies to a renewal.
- Your collection is not deleted if a subscription ends. Your data stays and you can still export it, but features above the free tier stop being available and free tier limits apply again.
- Beyond any refund right you have by law, refunds are at our discretion. Write to support@gestic.org and we will deal with you fairly.
8. Advertising
The free tier is supported by advertising, and the amount shown may vary with how you use the service. Paid plans reduce or remove it — see the subscription page for what your plan includes. Advertising is part of what makes the free tier possible, and blocking or interfering with it may limit access to free features.
9. Connected marketplaces and exports
Gestic can publish listings to marketplaces such as eBay on your behalf, and can export your collection in formats other services accept.
Any sale is between you and the buyer. Gestic is not the seller and is not a party to it. That means:
- You are responsible for the accuracy of your listings, for fulfilling orders, for returns and disputes, and for any tax or consumer-law obligation that comes with selling.
- The marketplace's own terms apply to what you do there, in addition to these.
- We may not learn of a sale immediately, so a card can remain on a Gestic list after it has sold — especially if you unlink the account. Keep your listings and your collection reconciled.
- Connecting an account is optional and you can disconnect at any time. What we store while it is connected is described in the Privacy Policy.
10. Acceptable use, and the API
You may use Gestic for managing your own collection and for the ordinary purposes the features are built for. You may not:
- scrape, crawl, bulk-download or systematically extract data from Gestic, including price data, card data, public profiles and public lists, by any automated means other than the API within its limits;
- resell, redistribute or build a competing product on data obtained from Gestic;
- exceed published rate limits, evade them with multiple accounts or keys, or otherwise place an unreasonable load on the service;
- attempt to access another member's account or data, probe or breach our security, or interfere with the service's operation;
- reverse engineer the service except where that right cannot lawfully be excluded;
- use Gestic to break the law or to infringe anyone's rights.
API keys are issued for your own use. You are responsible for traffic sent with your key, and we may rate-limit, suspend or revoke a key that is misused or that threatens the stability of the service.
The price and availability data Gestic collects is assembled at our own cost and effort. It is made available to you for managing your collection — not as a dataset to take.
11. Third-party content and intellectual property
Gestic is unofficial and is not affiliated with, endorsed, sponsored or approved by Wizards of the Coast LLC. Magic: The Gathering, card names, card images, mana symbols and related marks are the property of Wizards of the Coast. Portions of this site are unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy.
Card data and prices are provided by third parties, including Scryfall, under their own terms. We are grateful for that data and we pass it through as we receive it; we do not warrant it and we are not responsible for it.
Marketplace names and logos belong to their owners. Everything else in Gestic — the software, the design, the text, and our own compiled data — belongs to us and is protected by copyright and other laws. These terms grant you a personal, revocable, non-transferable right to use the service, and nothing more.
12. Availability, backups and data loss
Gestic is provided on a best-effort basis. We do not promise any level of uptime. The service may be unavailable for maintenance, for reasons outside our control, or because something has broken. Features may change or be withdrawn.
We take backups for our own operational purposes, but they are not a service we offer you and you must not rely on them. Gestic gives you an export tool for every list. Export your collection regularly and keep your own copy. If data is lost, your export is what restores it.
13. Disclaimer of warranties
To the fullest extent the law allows, Gestic is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory — including any implied warranty of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement.
We do not warrant that the service will be uninterrupted, secure or error-free, that card recognition will be accurate, that prices or valuations will be correct, or that any defect will be fixed.
Some jurisdictions do not allow certain warranties to be excluded. Where that is so, the exclusions above apply only as far as the law permits, and nothing here removes a right you have that cannot lawfully be removed.
14. Limitation of liability
To the fullest extent the law allows, Gestic is not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profit, revenue, data, goodwill, or business opportunity — including any loss arising from a price or valuation shown by Gestic, from a card identified incorrectly, from a sale you made or did not make, or from data that was lost or unavailable — even if we were told such loss was possible.
To the fullest extent the law allows, our total liability arising out of or relating to Gestic, on any basis, is limited to the greater of the amount you paid us in the twelve months before the event and CAD $100.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud, or for death or personal injury caused by negligence.
15. Indemnity
You agree to indemnify and hold Gestic harmless from any claim, loss, liability or reasonable cost (including legal fees) arising out of your content, your use of the service, your sales on connected marketplaces, your breach of these terms, or your infringement of anyone's rights.
16. Suspension and termination
You can stop using Gestic at any time, cancel a subscription from your account, and delete your account and its data using Delete My Account.
We may suspend or terminate an account that breaches these terms, that threatens the security or stability of the service, or where we are required to by law. Where it is reasonable to do so we will warn you first and give you a chance to put it right, and we will give you a reasonable opportunity to export your data — except where the breach makes that inappropriate.
Sections that by their nature should survive — prices and valuations, your content licence for content you leave published, acceptable use, intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive termination.
17. Changes to these terms
We may update these terms as Gestic changes. The date at the top of this page always shows when they were last updated. For a change that materially affects your rights we will give reasonable notice — by email or in the application — before it takes effect. Continuing to use Gestic after that means you accept the updated terms; if you do not, stop using the service and you may cancel or delete your account.
18. Governing law
These terms are governed by the laws of the Province of Quebec and the laws of Canada that apply there, without regard to conflict-of-law rules. The courts of the judicial district of Montreal, Quebec have exclusive jurisdiction, and both of us submit to them.
If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, or of your right to bring proceedings there where that law gives you that right.
19. General
- These terms and the Privacy Policy are the entire agreement between us about Gestic.
- If a provision is held unenforceable, the rest stays in force and that provision applies as far as it lawfully can.
- Not enforcing a right straight away does not waive it.
- You may not transfer your rights under these terms. We may transfer ours to a successor of the service, on notice to you.
- We are not liable for failing to perform because of something beyond our reasonable control.
